Terms and Conditions

These Terms and Conditions govern the provision of landscaping services by Marc Potter Landscaping Ltd (“the Company”, “we”, “us”, or “our”) to clients (“the Client”). By engaging our services, the Client agrees to these terms.


1. Scope of Services

The Company provides landscaping services including garden design, hard and soft landscaping, planting, construction of patios, pathways, retaining walls, decking, and ongoing maintenance. Services do not include structural building works beyond landscaping or any services not specifically agreed in writing.


2. Quotations and Estimates

All quotations are based on information supplied by the Client and site conditions observed at the time of quotation. Prices are indicative and may change if unforeseen circumstances arise, including soil conditions, drainage issues, or additional client requests.


3. Acceptance of Work

An order or agreement becomes binding once the Client confirms acceptance in writing or verbally and the Company acknowledges the agreement. The Company reserves the right to decline or suspend work at its discretion.


4. Payment Terms

Invoices are issued as per quotation or contract terms and must be settled within agreed payment periods. We may require deposits before commencing work. Late payments may result in suspension of ongoing work or additional charges.


5. Client Responsibilities

Clients must provide accurate site information, property access, and relevant requirements for the project. Delays or additional costs caused by incomplete or incorrect information are the responsibility of the Client.


6. Site Access and Safety

The Client must provide safe access to the site and ensure areas are clear of obstructions. The Company is not liable for delays caused by unsafe or inaccessible sites. Health and safety guidance provided by the Company must be followed.


7. Quality and Inspection

Clients should inspect work upon completion. Minor imperfections may occur as part of the trade and do not constitute a breach of contract. Any issues must be reported promptly for review.


8. Liability

The Company is not liable for indirect or consequential loss, including loss of revenue, use, or property value. Liability for direct loss is limited to the value of the contracted works. Nothing excludes liability that cannot legally be excluded.


9. Cancellations and Changes

Project changes or cancellations must be communicated in advance. Work already completed or materials purchased will be charged proportionally.


10. Force Majeure

The Company is not responsible for delays or failure caused by events beyond reasonable control, including adverse weather, supply shortages, or unforeseen site conditions.


11. Governing Law

These Terms and Conditions are governed by the laws of Scotland. Any disputes arising from services provided by Marc Potter Landscaping Ltd shall be subject to the jurisdiction of the Scottish courts.
